Membership Agreement

This Membership Agreement (“Agreement”) is entered into between Oak & Paddle Pickleball Club LLC (“Club,” “we,” or “us”) and the individual or entity signing below (“Member,” “you”).

By signing this Agreement, you agree to the terms below and acknowledge that you have received a copy of this Agreement. You also acknowledge and agree to the Club’s Privacy & Other Policies (available at oakandpaddle.com/policies), which are incorporated by reference into this Agreement.

1. Membership Tier and Term

You are enrolling in one of the Club’s membership tiers. The available tiers, pricing, initial terms, renewal terms, and benefits are described in Schedule A (Membership Tiers, Pricing, and Benefits) or on our website.

By signing this Agreement, you acknowledge the specific tier, term, pricing, and benefits applicable to your membership as selected at the time of enrollment. Memberships automatically renew according to the terms of your chosen tier unless canceled in accordance with this Agreement and Illinois law. Memberships are non-transferable.

2. Illinois Physical Fitness Services Act Disclosures

This Agreement complies with the Illinois Physical Fitness Services Act (815 ILCS 645).

– Total Payment Obligation: You agree to pay the full amount disclosed for the services in your chosen tier.

– Cancellation Rights: You may cancel this Agreement within 3 business days after the first business day following signing for a full refund. If you sign before the facility opens or not at an existing facility (for example, during pre-sale or online), you have 7 calendar days to cancel for a full refund. Notice must be provided in writing by certified or registered mail, through the cancellation form on the Club’s website (if signed online), or by email to [email protected]. Refunds will be issued within 30 days.

– Relocation: If you move more than 25 miles away and we cannot provide comparable facilities and services within 25 miles, you may cancel and will be liable only for charges up to the date of relocation plus a reasonable fee not to exceed 10% of the unused balance or $50, whichever is less.

– Death or Disability: You (or your estate) will be liable only for charges allocable to the time prior to death or disability upon reasonable evidence.

– Automatic Renewal: Notice will be provided before renewal as required by law.

3. Payments

Payments are due as scheduled. We may use third-party processors. Late payments may incur fees. All payments are non-refundable except as expressly provided in this Agreement or Illinois law.

4. Facility Access and Rules

Your membership grants access to the Club and benefits according to your tier at member rates. You agree to follow all rules in this Agreement and the Privacy & Other Policies. Violation of rules may result in suspension or termination of membership at the Club’s discretion. Non-use or low-use of the facility does not entitle you to credits or refunds.

5. Assumption of Risk and Waiver of Liability

**THIS IS A LEGALLY BINDING RELEASE — READ CAREFULLY BEFORE SIGNING.**

You understand and voluntarily assume all risks of injury or damage associated with Use of the Club’s premises, facilities, equipment, services, activities, and products, as more fully described in the Privacy & Other Policies.

On behalf of yourself, your spouse/partner, minor children/wards, guests, heirs, and assigns, you hereby release, waive, and discharge the Club, its owners, managers, employees, agents, and affiliates from any and all claims, liabilities, or damages arising from your or your guests’ use of the Club, including those caused by the negligence of the Club (to the fullest extent permitted by Illinois law). This does not waive claims for gross negligence or willful misconduct.

You agree to indemnify and hold the Club harmless from claims brought by third parties arising from your or your guests’ actions.

6. Photo/Video Release

You grant the Club the irrevocable right to use photographs, videos, or likenesses of you and your guests for any purpose whatsoever without compensation, as detailed in the Privacy & Other Policies.

7. General Provisions

– Governing Law: This Agreement is governed by the laws of the State of Illinois.

– Entire Agreement: This Agreement, together with the Privacy & Other Policies and Schedule A (Membership Tiers & Benefits), constitutes the full understanding between the parties.

– Severability: If any provision is held invalid, the remainder remains enforceable.

– Changes: Material changes to this Agreement will be communicated to you in writing.

Prices are subject to change with 30 days’ notice for renewals.
All memberships include access to the facility during published hours.
Guest passes are non-transferable.
